TERMS OF SERVICE

By commissioning me, Spencer "Lambeasts" Chitwood (hereby refereed to as the Artist) you (the Client) are agreeing to these legally binding Terms of Service (hereby referred to as the TOS).
Any violation of these terms will result in consequence, ranging from prohibition from future service to legal action.
What constitutes a violation of the TOS is subject to the Artist's, or the Manager's discretion.
These terms are subject to change at any time.

The Artist has every right to refuse service to any Client under any circumstance. The Artist is NOT obligated to provide a reason for this refusal of service.
The Artist has the right to refund a paid service at any point during contract between Artist and Client. The Artist is not obligated to provide a reason.
The Client MUST be eighteen (18) years of age to commission adult oriented, "not-safe-for-work" pieces. There are NO exceptions. If the Artist or the Manager has any reason to believe the Client is younger than eighteen years, the Client is REQUIRED to submit valid legal identification for proof of age.
This is a legally binding contract.
These Terms shall be construed in accordance with the internal laws of the State of Florida without regard to the conflict of laws provisions thereof. Claims or other causes of action arising out of or related to these Terms shall be litigated exclusively in the appropriate state or federal courts situated in Alachua County, Florida, and the Parties hereby consent to the personal jurisdiction of such courts.
Unlawful conduct, illegitimate chargebacks, bounced e-checks after product/service has been rendered, and other fraudulent infractions are subject to litigation.

For the protection of the Artist and the Client, payments are only conducted using PayPal. All prices are in United States Dollars (USD). International Clients are required to pay a currency conversion fee through PayPal.
Payment is required upfront, unless a payment plan has been discussed prior.
Payment plans are not accepted for services totally less than one-hundred dollars USD ($100). In the case of a payment plan, the commissioned piece(s) will not be started until the payment is received in full.
The Artist has the right to up-charge for complicated or complex subjects and/or characters. What constitutes complex is under the discretion of the Artist or the Manager, and will be discussed before a price is quoted.
Refunds are not permitted under any circumstances. The Client must be certain the payment sent is available to be spent. Bills and necessities come before luxuries, remember.

The Artist own full copyright to any piece produced.
The Client may not copy, mass print/produce, alter, claim, or otherwise reproduce a commissioned piece.
The Client has the right to post purchased custom artwork to personal galleries and image hosting sites with proper credit to the artist.
The Client is not permitted to post or distribute pieces without watermarks on public galleries. Unmarked images can be provided to other artists for reference purposes only.
The Client is strictly prohibited from profiting from the commissioned piece, including but not limited to, paid access of viewing, print on clothing or canvas, etc. Exceptions may be made but only after royalties have been discussed and paid.
